Maternity Leave in India
Maternity benefits in India are primarily governed by the Maternity Benefit Act, 1961, as amended by the Maternity Benefit (Amendment) Act, 2017. The Ministry of Labour & Employment states that the Act regulates maternity benefits for women employed in covered establishments and provides maternity and other related benefits.
The 2017 amendment increased maternity leave from 12 weeks to 26 weeks for women with fewer than two surviving children. It also introduced provisions relating to adopting mothers and commissioning mothers.
The Ministry’s published material also describes additional provisions under the Act, including nursing breaks, work-from-home arrangements in applicable cases and crèche facilities for establishments meeting the prescribed employee threshold.
Maternity Leave Entitlement
The maternity leave entitlement depends on the circumstances of the employee.
First or Second Child
A woman with fewer than two surviving children is generally entitled to 26 weeks of maternity benefit.
Of these 26 weeks, not more than 8 weeks may precede the expected date of delivery.
For example, where 8 weeks are taken before the expected delivery date, the remaining 18 weeks fall after the pre-delivery period.
Third Child or Beyond
A woman having two or more surviving children is entitled to a maximum of 12 weeks of maternity benefit, of which not more than 6 weeks may precede the expected date of delivery.
Adoption
An eligible woman who legally adopts a child below three months of age is entitled to 12 weeks of maternity benefit from the date the child is handed over to her, subject to the conditions of the Act.
Commissioning Mother
A commissioning mother is also entitled to 12 weeks of maternity benefit from the date the child is handed over, subject to the conditions of the Act.
Eligibility for Maternity Benefit
The Maternity Benefit Act contains eligibility and applicability conditions.
The Ministry of Labour & Employment states that, for maternity benefit under the Act, a woman generally needs to have actually worked for at least 80 days in the 12 months immediately preceding the date of her expected delivery.
The applicability of the Act also depends on the nature of the establishment and other statutory conditions. The Ministry’s published summary refers to covered factories, mines, plantations, circus establishments and shops or establishments employing 10 or more persons, subject to the provisions and exclusions applicable under the law.
Therefore, the employee’s employment status, establishment coverage and applicable statutory provisions should be checked before relying on a calculated entitlement.
How Is Maternity Leave Calculated?
For childbirth cases, the maternity leave period is based on the statutory entitlement and the date from which maternity benefit is availed.
For example:
26-week entitlement
If an employee chooses to take 8 weeks before the expected date of delivery:
26 weeks total − 8 weeks before delivery = 18 weeks after the pre-delivery period
The calculator uses the selected pre-delivery period to estimate the leave start date and the corresponding leave end date.
For categories where the statutory entitlement is 12 weeks, the calculator applies the applicable 12-week period.
Actual Date of Delivery
The expected date of delivery is an estimate. If the actual delivery occurs on a different date, the actual circumstances and the provisions of the Act should be considered when determining the applicable maternity benefit period.
For this reason, the dates generated by this calculator should be treated as an estimated planning schedule, rather than a substitute for statutory determination.
Other Maternity Benefits and Provisions
The Maternity Benefit Act contains provisions beyond the basic maternity leave period.
Depending on the circumstances and applicability of the Act, these may include:
- Maternity benefit payment
- Leave relating to miscarriage or medical termination of pregnancy
- Nursing breaks after returning to work
- Medical bonus in applicable cases
- Work-from-home arrangements where the nature of work permits and the required conditions are met
- Crèche facilities for establishments meeting the prescribed employee threshold
- Protection against dismissal or other adverse treatment during the protected period under the Act
The Ministry of Labour & Employment identifies these as provisions/benefits associated with the Maternity Benefit Act.
The exact entitlement should be checked against the statutory provisions applicable to the employee and establishment.
Important Points to Remember
1. The calculator provides estimated dates
The calculator is intended for planning and general reference. It does not replace the employer’s statutory assessment or professional legal advice.
2. Expected delivery date and actual delivery date may differ
The expected date of delivery is used for planning the pre-delivery period. The actual date of delivery may affect the applicable leave calculation.
3. Eligibility should be checked separately
Meeting the 80-day working requirement alone does not determine every aspect of entitlement. The applicability of the Act and other statutory conditions should also be considered.
4. Adoption and commissioning mother cases are different
For eligible adopting and commissioning mothers, the 12-week maternity benefit is linked to the date the child is handed over rather than the expected date of delivery.
5. Statutory provisions may change
Labour laws and applicable rules may be amended, replaced or supplemented by subsequent notifications, rules or legislation. Always verify the latest applicable provisions before making an HR or payroll decision.
